Infringement Complaint Guideline

Poizon's Infringement Complaint Guideline is intended for use by the intellectual property right holders or any third parties to the “POIZON Platform” when they find that the relevant content displayed on the “POIZON Platform” infringes the right holder's or others' intellectual property related rights.


Ⅰ. The scope of complaints/reports accepted is as follows:

1. Trademark infringement, such as the use of trademarks identical or similar to IP right holder's trademarks;

2. Copyright infringement, such as unauthorized use of a third party's copyrighted work or sale of unauthorized copies;

3. Patent infringement, such as infringement of design patents;

4. Other intellectual property infringement cases.

Ⅱ. The documents to be submitted are as follows:

1. the complainant/reporter's identity documents (i.e., the materials to verify your identity)

(1) if you are a natural person, please submit to us: a scanned copy of your ID card with both front and back sides;

(2) If you are a legal person or other kind of organization, please submit to us: a scanned copy of your business license;

(3) If you entrust an agent to file a complaint/report, please submit to us: a copy of the power of attorney.

2. Proof of ownership of the right holder

It shall include, but not be limited to, copyright certificates, trademark certificates, patent certificates, certificates proving the date of the first public publication or distribution of the work, creative manuscripts, time stamps of the creation of the work issued by institutions with authority, certificates of the record of the work and other effective ownership certificates proving that the right holder owns the relevant rights.

3. Proof of infringement by the complainant's

It can be the complainant's account information, the link that shows infringement facts, or the description of the complaint.

Ⅲ. Guarantee Statement

The complainant shall guarantee in writing that the statements and related materials provided in the complaint are true, valid, and legal, and guarantee to bear all the legal consequences arising from the complaint, including but not limited to any losses caused by the measures taken by “POIZON Platform” based on the complaint.

Ⅳ. Acceptance requirements and time limit

In order to ensure that your complaint can be dealt with as quickly and effectively as possible, you should ensure that the materials you submit are true and effective, and that the platform will only accept the same complaint/reporting subject matter initiated by “POIZON Platform ”once (except for other special circumstances).

We will verify the circumstances and get back to you within 10 working days after receiving the above valid complaint information.

If you have already filed a complaint, report, or lawsuit to the administrative department or court due to the infringing behavior of the respondent, please submit the relevant proof of acceptance and evidence materials together with the complaint application.
